These Terms & Conditions ("Terms") govern your use of and access to all websites (including rootdpet.com), membership and coaching platforms, courses, webinars, workshops, landing pages (including opt-in pages), community spaces, and related services offered by Functional Pet Wellness LLC d/b/a Rootd Pet ("Company," "Rootd," "we," "us," "our").

By accessing or using our services in any way, you ("User," "you," "your") agree to be legally bound by these Terms and our accompanying Privacy Policy. If you do not agree with all provisions, discontinue use immediately.

Important: Rootd provides educational and coaching services for pet wellness. Rootd is not a veterinary practice, and nothing we provide is veterinary advice, diagnosis, or treatment. Please read Section 7 carefully.

2. SCOPE OF SERVICES

(1) Primary Offering: We provide educational and coaching programs focused on holistic, whole-pet wellness, helping pet parents build individualized wellness routines, habits, and plans for their pets, always intended to work alongside (and never to replace) their veterinarian.

(2) Included Services:

• Online courses, video lessons, PDF guides, checklists, and templates

• One-on-one and group coaching, including our whole-pet coaching program ("Rootd: The 90-Day Whole-Pet Longevity Partnership") and its tiers, featuring written wellness plans, weekly check-ins, and progress reviews

• Webinars, workshops, and virtual events (live or pre-recorded)

• Community forums, group coaching calls, and personalized feedback

• Curated product and brand recommendations and related wellness resources

• Where offered, a third-party health-tracking device and/or app used to log general wellness data (see Section 2(4))

(3) Advertising: We run paid advertisements on various platforms (e.g., Facebook, Instagram, Google Ads), directing users to our websites, landing pages, and event or consultation sign-up forms.

(4) Third-Party Devices and Tools: Some programs may include or recommend a third-party health-tracking device or application (for example, an activity and sleep tracker). Any such device or app is provided by its own manufacturer or provider and is governed by that provider's separate terms and privacy policy. Data from these tools is general wellness information only, is not diagnostic or medical-device output, and should never be used in place of veterinary evaluation.

(5) Not Veterinary Services: We do not diagnose, treat, cure, or prevent any disease or medical condition, prescribe medication, or provide veterinary care. Our coaching supports the lifestyle, nutrition, routine, and enrichment choices you make together with your veterinarian.

3. ELIGIBILITY & USER RESPONSIBILITIES

(1) Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services.

(2) Legal Capacity: By accessing or using our services, you represent that you have the legal capacity to enter a binding agreement.

(3) Accurate Information: You agree to provide truthful, current information and to promptly update any changes.

(4) Responsibility for Your Pet: You remain solely responsible for your pet's care and for all decisions about your pet's health, and you agree to consult your veterinarian before making changes to your pet's diet, supplements, medication, exercise, or care plan.

4. ACCOUNT REGISTRATION

(1) Certain services require you to register. You agree to provide accurate, up-to-date information when creating an account.

(2) You are responsible for maintaining the confidentiality of your login credentials. Notify us at [email protected] if you suspect unauthorized use.

5. FEES, PAYMENTS & REFUND POLICY

(1) Fees & Billing: Some services (e.g., coaching programs, memberships, one-time sessions or courses) require payment. Fees are disclosed at purchase. Recurring subscriptions (such as monthly coaching) bill automatically until cancelled in accordance with these Terms and the plan you selected. We may change pricing upon notice.

(2) Minimum Commitment: Certain coaching tiers carry a stated minimum commitment (for example, a three-month minimum term). Where a minimum term applies, it is disclosed at purchase, and starting the program means you agree to complete and pay for that minimum term.

(3) Payment Methods: We use third-party payment processors (e.g., Stripe). By submitting your payment information, you authorize us to charge applicable fees.

(4) Refunds:

• Except where prohibited by applicable law, fees are generally non-refundable once access to a program, session, or digital content has been granted.

• Rootd's service guarantee (the "Rootline Commitment," where offered) is a promise about our service deliverables only, for example delivering your written plan, holding your scheduled calls, and responding within the stated time. If we fail to deliver a service commitment we have made, our remedy is to continue performing that service at no additional charge until it is delivered. The service guarantee is not a guarantee of any health, wellness, or financial outcome, and does not by itself entitle you to a refund.

• Any conditions attached to a specific guarantee (such as completing your intake, attending scheduled calls, and logging tracker data) must be met for that guarantee to apply.

• To raise a guarantee or billing question, email [email protected] before any stated deadline with any required information.

(5) Late/Failed Payments: If a payment fails, we may suspend or cancel your access until the balance is settled. Suspension does not relieve you of amounts owed under a minimum term.

(6) Chargebacks: Please contact us first to resolve any billing issue. Initiating a chargeback without contacting us may result in suspension of your access.

6. INTELLECTUAL PROPERTY

(1) All content (videos, PDFs, wellness plans, scripts, text, images) is owned by or licensed to the Company and protected by law.

(2) We grant you a limited, non-exclusive, non-transferable license for personal, non-commercial use in connection with your own pet(s).

(3) You may not reproduce, distribute, resell, modify, or exploit our content, plans, or materials without written permission.

(4) User-Generated Content: If you post or upload anything on our platforms, you confirm you own or have permission to share it. You grant us a royalty-free license to use it for service operations.

7. DISCLAIMER OF RESULTS & EARNINGS

(1) Educational and Supportive Only. All materials, coaching, plans, and communications are provided for general educational and informational purposes to support your pet's overall wellness. They are not veterinary advice.

(2) Not a Veterinarian; No Diagnosis or Treatment. Carter Easler and Rootd are not veterinarians and do not provide veterinary services. Nothing we provide diagnoses, treats, cures, or prevents any disease or medical condition, and nothing we provide is a substitute for examination, diagnosis, or treatment by a licensed veterinarian.

(3) Always Work With Your Vet. You should consult your veterinarian before changing your pet's diet, supplements, medication, exercise, or care, and for any medical concern. Our role is to support and coordinate with your veterinarian, never to replace or override them.

(4) Emergencies. If your pet is experiencing an emergency or you suspect a medical problem, contact your veterinarian or an emergency animal hospital immediately. Do not rely on our services for urgent or emergency care.

(5) No Outcome Guarantee. Every animal is different. We do not and cannot guarantee any specific health, behavioral, longevity, or wellness result for your pet. Any forward-looking statements describe possibilities, not promises.

(6) Testimonials. Testimonials and case studies reflect individual, real experiences and observable, quality-of-life impressions shared by clients. They are not guarantees and do not represent that you or your pet will experience the same results.

(7) Not Professional Advice. We are not veterinarians, financial advisors, attorneys, or tax professionals. Consult the appropriate licensed professional for personalized advice.

8. DATA COLLECTION & PRIVACY

(1) We collect personal data (e.g., name, email, phone, pet information) and usage data (IP address, device info).

(2) We may use tools such as the Facebook Pixel and Google Analytics to understand user behavior and optimize our advertising. By using our services, you consent to such tracking as described in our Privacy Policy.

(3) SMS/Text Messaging Program. By providing your mobile number and opting in, you consent to receive recurring automated marketing and informational text messages from Rootd Pet, including appointment and call reminders, program and account updates, wellness tips, promotional offers, and customer support. Consent to receive marketing texts is not a condition of purchasing any product or service. Message frequency varies. Message and data rates may apply. You can reply STOP at any time to unsubscribe, or HELP for assistance. For support, email [email protected]. Carriers are not liable for delayed or undelivered messages.

(4) Compliance. We comply with GDPR, CCPA, CAN-SPAM, TCPA, and other applicable laws to the extent required.

9. COMMUNITY GUIDELINES & USER CONDUCT

(1) Our community features (forums, calls) require respectful interaction.

(2) Prohibited Content: You must not post unlawful, defamatory, harassing, or otherwise objectionable material, and you must not use the community to provide veterinary, medical, or professional advice to other members.

(3) We may remove content that violates these guidelines.

(4) Bullying, hate speech, or harassment is strictly prohibited.

10. LIMITATION OF LIABILITY

(1) Our services are provided "as-is" and "as-available" without warranties of any kind, express or implied.

(2) To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages (including lost profits), or for any decision you make regarding your pet's care, diet, or treatment.

(3) You assume full responsibility for the choices you make for your pet, which you make in consultation with your veterinarian.

(4) Our total aggregate liability shall not exceed the fees you paid to us in the three months preceding the claim, or $100, whichever is greater.

(5) Certain jurisdictions may limit these disclaimers; where that is the case, our liability is restricted to the maximum extent allowed by law.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Functional Pet Wellness LLC d/b/a Rootd Pet, its owners, affiliates, and personnel from any claims arising out of your breach of these Terms, your misuse of our services, or decisions you make regarding your pet.

12. ADVERTISING & COMPLIANCE

(1) We run ads on platforms such as Facebook, Instagram, and Google, complying with their policies.

(2) We do not make false or misleading claims, and we do not advertise that our services diagnose, treat, cure, or prevent any disease. Testimonials reflect individual experiences, not guarantees.

(3) By interacting with our ads, you consent to data collection as described in our Privacy Policy.

13. DISPUTE RESOLUTION & GOVERNING LAW

(1) These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

(2) Any dispute shall be resolved by binding arbitration in Kings County, New York, under the Rules of the American Arbitration Association (AAA).

(3) No Class Actions: You waive any right to participate in class or representative actions.

(4) Either party may seek injunctive relief for intellectual property violations in a court of competent jurisdiction.

14. TERMINATION

(1) You may cancel your account or subscription at any time by contacting [email protected], subject to any applicable minimum term (see Section 5(2)).

(2) We may suspend or terminate your access if you violate these Terms.

(3) Upon termination, all licenses end immediately, but disclaimers, limitations, payment obligations for any minimum term, and other provisions that by their nature should survive will survive.

15. INTERNATIONAL USERS

(1) We make no representation that our services are appropriate or available globally. You are responsible for compliance with local laws.

(2) If accessing from outside the US, you do so at your own risk.

16. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Material changes will be posted with an updated "Last Updated" date. Continued use after changes indicates acceptance.

17. SEVERABILITY & WAIVER

(1) If any provision is deemed invalid by a court, the remaining provisions remain in effect.

(2) No waiver of a right or provision is a waiver of any other right or provision.

18. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and any legal notices referenced, constitute the entire agreement between you and Functional Pet Wellness LLC d/b/a Rootd Pet regarding the services.
